This Memoradum of Understanding, entered into on March 26,1999, at Johnson City, New York, between representatives of the United States Postal Service and the designated agents of the Union signatory to the National Agreement/APWU pursuant to the local implementation provision of the 1999 National Agreement. This Memorandum of Understanding constitutes the entire agreement on matters relating to local conditions of employment.

ART. 30, SEC. A LOCAL MEMORANDA OF UNDERSTANDING:
A. TECHNOLOGICAL CHANGES
Prior to the installation of new technological, automated or mechanized equipment, management will meet with APWU to discuss and evaluate the impact on the employees in the installation.
B. LABOR-MANAGEMENT RELATIONS
1. Labor-management meetings will be held on the first Tuesday of the month at a mutually determined time.
a) By mutual consent, additional meetings may be called by either party.
b) The Union will provide management with an agenda at least 7 days prior to the scheduled meeting.
c) Minutes of these meetings will be reviewed by both parties for corrections, additions and deletions, if necessary. Upon mutual agreement, both parties will sign, indicating acceptance.
2. The November meeting is designated for the purpose of discussing Christmas operations. This is in case the December meeting is canceled due to, too much activity.
3. Craft announcements will be permitted on public announcement system with prior approval of management.
1. The local Union president, Greg Nowark, shall be notified promptly of the hiring of casual employees in crafts represented by the APWU.
2. Each craft shall be provided space for a bulletin board, in all facilities, and be allowed other reasonable space for literature.
3. The Union will be provided written notification of the scheduling of craft orientation for new employees represented by the APWU.
C. USE OF TELEPHONES
Management will allow reasonable use of telephone by authorized union officials and stewards relating to the administration of the National Agreement.
D. INTERPRETATION OF AGREEMENT
If a question of interpretation of any section or part of this agreement arises, members of the original negotiating teams, if available, shall meet and attempt to reach an understanding of intent. The agreement arrived at shall be binding on both parties.
If no agreement is reached, the matter will be subject to the grievance/arbitration procedure.

ARTICLE 30, SECTION B
1. WASH-UP
Reasonable time to be allowed for end-of-tour wash-up time, dependent on work that had been performed. This wash-up time is for paperwork, tool and cleaning equipment storage transfer of working information to successive personnel and personal cleansing. Generally, five minutes wash-up time prior to lunch will be sufficient, with additional time for filthy jobs.
Wash-up times are not to be used for an additional break.
2. REGULAR WORKWEEK
Establishment of a regular workweek of five days with fixed days off. To the maximum extent practicable within operational needs, regular schedules shall have consecutive nonscheduled days.
3. EMERGENCY CURTAILMENT AND/OR TERMINATION OF POSTAL OPERATIONS
It is recognized by both parties that, on occasion, emergency conditions may exist which would encourage the employer to consider the curtailment of operations. In cases of such emergency conditions, the employer will, prior to making a decision to curtail the operations, take into consideration such factors as:
1. The degree of emergency as stated by local government and police authorities. The installation head, or designee, will consult with local authorities on emergency conditions and disasters., After determining the effects it will have on USPS employees, and the decision has been made to curtail and/ or terminate operations, the installation head, or designee, will, through the use of a phone tree, give instructions to be followed by postal employees, on and off postal premises.
2. Prior to taking action to curtail operations, the employer will notify the union of its decision and its plan of implementation.
3. According to the ELM 519.21 if it is an "Act of God", Administrative leave will be used accordingly. (Johnson City will use Administrative leave if the Binghamton Post Office deemed it necessary to use it for the same conditions.)

4-12 LOCAL LEAVE PROGRAM
1. PRIME TIME
A. Duration of the entire year except 12/1-12/24. ( no one is to be on leave during this period.)
B. Only one employee is permitted off for an entire week, except for incidental leave. Unless the work force increases or the work load decreases. Then this number will be re-negotiated.
C. Bidding starts Jan 2nd of each leave year.
D. Three rounds of bidding.
1. First Round and Second Round
a. Senior to Junior in successive order.
b. Employees are allowed to bid:
1) Three consecutive weeks
2) Two consecutive weeks and one lone week
1) Two individual weeks
2) One individual week
3) Pass to next employee
c. Not to exceed the amount of time saved and time to be earned during the present year.
2. Third Round
a. To be reserved for people who have an excessive amount of time saved or who passed on one or both of the previous rounds.
E. All clerks must bid and/or use any excess annual by 11/30 of any given year or risk the chance of losing any over accumulated annual leave.
A. Bid weeks begin on Sunday.
B. Jury duty and attendance at National or State Conventions are not to be charged as choice vacation bids.
1. But if known prior to bidding this week will be blocked off for anyone to bid. Until more than one employee is allowed off a week.
H. All vacation choices are to be posted on the employees vacation schedule located on the workroom floor, as vacations are bid.
2. INCIDENTAL LEAVE
A. Clerk submits triple 3971, at their earliest possible convenience.
1. Copy one-management.
2. Copy two-for acceptance or denial.
3. Copy three-to show that it was received.
B. Approval/denial
1. Postmaster has three days within 30 to approve or deny.(30 days being the 30 days prior to the scheduled leave day or period.)
2. If not returned in this time frame leave is automatically approved.

3. If denied, Postmaster/Supervisor has the obligation of not approving any other slips for the same time frame unless they approve the previous denial first.
4. Last minute incidental leave must be approved or denied by the Wednesday prior if not immediately.
13. SUNDAYS AND HOLIDAYS
A. PTF volunteers first.
B. In case, there are no volunteers. Work the junior PTF then rotate up through seniority.
C. The next Sunday or holiday would continue the rotation.
14. OVERTIME
A. Overtime should be equalized quarterly among the OT list.
B. Overtime list should be posted, depicting yes/yes and yes/no employees.
15. LIGHT DUTY
A. The following jobs are designated light and/or limited duty. (Depending upon injury and/or availability.) These will only be used as long as every one else is getting their normal hours.
1. Filing CFS Ans. Phones Sorting
Filing Xeroxing UBBM
labeling Computer Other similar jobs
16. PARKING
A. Contract to be signed again for the lot next door. This will give us parking until 2003.
B. If contract is not signed for the parking lot next door, no clerk will have to walk any further than the immediate JCPO parking lot if they have to enter or leave the PO in the dark. This is to be considered a safety hazard.
