Memorandum of Understanding



This memorandum of understanding, entered into on November 30. 1981 at Oneonta NY between the Representatives of the U S Postal Service, and the designated agent of the union signatory to the National Agreement. APWU pursuant to the local implementation provision of the 1987 National Agreement. This memorandum of Understanding constitutes the entire agreement on matters relating to local conditions of employment.


ITEM #1: "Additional or longer wash-up periods."


Each clerk will be to allowed a three-minute wash-up period before lunch and also before quitting time.


ITEM #2. The establishment of a regular work week of five days with either fixed or rotating days off.


The regular work week shall consist of five days with fixed days off.


ITEM #3. Guidelines for the curtailment or termination of postal operations to conform to orders of local authorities or as local conditions warrant because of emergency conditions. -


Section 519.21 of the Employee and labor Relations manual which defines Acts of God and establishes guidelines for Postmasters to determine when

employees should both be dismissed early as well as when they are unable to report.

ITEM #4: Formulation of local program" .

1. Ill During Vacation: 'Clerks who become ill while on annual leave during choice period shall be allowed to have another selection during the choice period if available.

2. Re-posting of Cancellations: 'All cancellations shall be re-posted as soon as management is notified of the cancellation. All clerks will notify management two weeks prior to cancelling of prime time leave except In emergency situations. Bids will be awarded to the next senior bidder below cancellation. 3. Exchanging of Leave: "There shall be no exchanging of leave"


4. Vacation Call--In: No clerk will be called in to work while on annual leave except In a serious emergency situation.

5. Military Leave: Military leave will not count as part of a clerks

selections for the choice period, nor will it count against the Branch's quota for the choice period.


6.Posting of Scheduling: "Management will post the leave chart as soon as it has been completed."

ITEM 5. The duration of the choice vacation period.


The choice vacation period shall begin with the first full week of May and end with the last week in September for the years 1988. 1989. and 1990.


ITEM 6. The determination of the beginning day of any employees vacation period.


The leave week during the choice vacation period shall be Monday through Saturday.


ITEM 7. 'Whether employees at their option may request two selections during the choice vacation period. in units of either 5 or 10 days.


Clerks, at their option. may request one (1) or two (2) selections during the choice vacation peried in units of either five (5) or ten (1O) or fifteen (15) days; total not, to exceed ten (10) or fifteen (15) days on the first choice. In accordance with leave earned annually. Any additional prime time vacation available will be granted On a second round of selection with same rules applying as on first choice.


ITEM 8. Whether jury duty and attendance at National or State Conventions shall be charged to the choice vacation period.


Clerks on jury duty during the choice vacation period shall be eligible for another available period within the choice vacation period.

Jury duty will not be considered as part of the quota of clerks off during the choice vacation period.



ITEM 9: Determination on of the minimum number of employees who shall receive leave each week during the choice vacation period.


There shall be two (2) clerks off each week during the choice vacation period for the first two rounds of selection.


The initial period of bidding for the choice period will commence on January 1st and end on February 28th each year. Management shall post the leave chart as soon as the first round of bidding is completed but not later than March 31st.

ITEM 10. The issuance of official notices to each employee of the vacatiom schedule approved for such employee.


Each clerk craft employee will submit, following final selection of their choice vacation period(s). Form 3971 in duplicate, filling In all applicable items. A copy, signed by the responsible Supervisor, will be returned to each clerk craft employee within 24 hours.

ITEM ll. Determination of the date and means of notifying employees of the beginning of the new leave year.


As soon as management receives official notification from the Postal Data Center of the beginning of the new leave year. it shall be placed on the bulletin board. This must be no later than the first work day in January.


ITEM 12. The procedures of submission of applications for annual leave during other than choice vacation period.


Clerks requesting annual leave outside the choice period must submit Form 3971 fourteen (14) days in advance unless emergency or unexpected situations occur. Management will reply, indicating approval or disapproval, within three (3) days following submission of Form 3971. Daily leave shall be granted on a first-come. first-served basis while leave in advance shall be granted on a first-come, first-served basis.


These rules will also apply, but are not limited to. weddings, graduations. extended trips. etc. where advance planning is necessary. Station Supervisors will date Form 3971 when the request for leave is made. Supervisors will indicate numerically the order of receipt of the Forms 3971 for identical days. The earliest date request/requests shall be honored in numerical order when sufficient replacements are not available to honor all requests.


ITEM 13. 'The method of selecting employees to work on a holiday.


Management will follow the National Agreement.


ITEM 14. Whether Overtime Desired lists in Article 8 shall be by section and/or tour.


Overtime desired lists will be by sections as defined in this Memorandum of Understanding.


Non-scheduled Days Off - Holidays - Extra Hours shall comprise a separate section on the overtime desired list.


ITEM 15. "The method to be used in reserving light duty assignments so that no regularly assigned member of the regular work force will be adversely affected.

ITEM 16. The identification of assignments that are to be considered light duty within each craft represented in the office.

Identification of Light Duty Assignments a "light duty" assignment is any assignment within the physical capability of an employee who is temporarily or permanently incapable of performing his/her normal duties as a result of illness or injury. Determination of capabilities will be determined by the employee's attending physician in writing.

ITEM 17. The determination as to whether annual leave to attend Union activities requested prior to determination of the choice vacation schedule is to be part of the total choice vacation plan.

ITEM 18. Those other items which are subject to local negotiations as provided in the craft provisions of the Agreement.

ITEM 19. Local implementations of the Agreement relating to seniority, reassignments and posting.

"Notice inviting bids for clerk craft assignments and to such other assignments to which a clerk is entitled to bid shall be posted on the official bulletin board for ten (10) days. Copies of the notice shall be given to the local Union. When an absent employee has so requested,in writing, stating his or her mailing address, a copy of any notice inviting bids shall be mailed to the employee.

"Clerks shall make their bids in writing to the Manager in charge by 5:O0 p.m. on the final day. When more than one assignment is posted, clerks shall have the right to bid for all assignments stating their preference (i.e., 1st choice _______: 2nd choice _______; and 3rd choice_______). A Union representative Shall be present when the bids are opened."

ITEM 20. Each window clerk will be allowed personal time not to exceed ten (10) minutes during the course of his/her tour if their tour is four (4) hours continuous duty without a lunch break.

This Memorandum of Understanding is entered into on November 30, 1987 at Oneonta, NY 13820. between the representatives of the U.S. Postal Service and the designated agent of the local branch of the APWU, pursuant to local implementation provision of the 1987 National Agreement.
